By using cafeutopia.com or placing an order, you agree to these terms, along with our Shipping, Return & Refund, Subscription and Privacy policies.

Who can buy

You must be at least 18 years old and live in the United States to place an order.

Our products and your health

Cafe Utopia products are dietary supplements. They are not intended to diagnose, treat, cure or prevent any disease. Statements on this site have not been evaluated by the Food and Drug Administration.

Our products contain caffeine. They are not recommended for children, pregnant or nursing women, or people sensitive to caffeine. Talk to your physician before use if you have a medical condition or take medication. Use the products only as directed on the label.

Information on this site is general and is not medical advice.

Orders, prices and payment

  • Prices are in US dollars and are shown at checkout, along with shipping and tax.
  • We may refuse or cancel an order, for example for a pricing error, suspected fraud, or an item out of stock. If we cancel after charging you, we refund you in full.
  • Product images are for illustration. Packaging may vary slightly.
  • Subscriptions renew automatically as described in our Subscription Terms.

Promotions and free gifts

Promotions and free gifts, like the free mug, are available while supplies last, can't be exchanged for cash, and may end at any time. A free gift may be swapped for a similar one if the original runs out.

Your account

Keep your login details private. You're responsible for activity in your account. Tell us right away if you think someone else has used it.

Acceptable use

Don't misuse the site: no attempts to break in, scrape it, resell our products without our written permission, or abuse promotions or our refund policy.

Intellectual property

The Cafe Utopia name, logo, images and content belong to us or our licensors. You may not use them without our written permission.

Disclaimers and limits of liability

The site and products are provided "as is" to the extent the law allows. Our total liability for any claim related to an order is limited to the amount you paid for that order. We are not liable for indirect or consequential damages. Some states don't allow these limits, so they may not apply to you.

Disputes

These terms are governed by the laws of the State of Florida. Please contact us first: most problems can be solved quickly by email.

Arbitration and class action waiver

Please read this section carefully. It affects your legal rights, including your right to go to court and to join a class action.

  1. Try to resolve it informally first. Before starting arbitration, you or we must send the other a written notice describing the dispute and the relief sought. Send yours to support@cafeutopia.com and to Cafe Utopia LLC, 1002 Jupiter Park Lane, Suite 1D, Jupiter, FL 33458. If we can't resolve it within 60 days, either side may start arbitration.
  2. Binding individual arbitration. Except as stated below, any dispute between you and Cafe Utopia arising from or relating to these terms, our products, our website, or any order or subscription will be resolved by binding arbitration, not in court. This includes claims based on contract, statute, fraud or any other legal theory, and disputes about the scope or enforceability of this section.
  3. Rules and provider. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, available at adr.org. The Federal Arbitration Act governs this section.
  4. Location and format. The arbitration will take place in the county where you live or by phone or video, unless both sides agree otherwise. For claims of $10,000 or less, you may choose to have it decided on written submissions only.
  5. Costs. Fees are paid as the AAA Consumer Arbitration Rules provide. For claims under $10,000 that are not frivolous, we will pay your filing fee and the arbitrator's fees.
  6. Exceptions. Either side may bring an individual claim in small claims court if it qualifies. Either side may also ask a court to stop infringement of intellectual property.
  7. Class action waiver. You and Cafe Utopia agree to bring claims only on an individual basis, not as a plaintiff or class member in any class, collective, consolidated or representative action or arbitration. The arbitrator may not combine more than one person's claims and may award relief only to the individual party bringing the claim.
  8. Jury trial waiver. You and Cafe Utopia waive any right to a jury trial for disputes covered by this section.
  9. Your right to opt out. You may opt out of this section within 30 days of first accepting these terms by emailing support@cafeutopia.com with your name, address and a clear statement that you opt out of arbitration. Opting out doesn't affect any other part of these terms.
  10. If part of this section is unenforceable. If the class action waiver is found unenforceable for a claim, that claim must be decided in court, not arbitration, and the rest of this section still applies to other claims. Any court case allowed under these terms will be brought in the state or federal courts in Palm Beach County, Florida.
  11. Changes. If we change this section, the change won't apply to a dispute that arose before the change, and you may reject it by emailing us within 30 days.
  12. Survival. This section continues to apply after your account closes or your relationship with us ends.

Changes

We may update these terms. The effective date at the top shows the latest version. Orders placed before a change follow the terms in effect when they were placed.
